Is Kratom Legal in Wyoming?

Wyoming is known for some of the harshest cannabis laws left in the United States. Unlike its border states Colorado, Montana, and Utah, cannabis remains illegal in Wyoming. As of this writing Wyoming has no legal recreational or medicinal marijuana program.

So where does Wyoming fall on kratom?

Wyoming has thus far taken no action on kratom. It is neither regulated nor banned. A quick Google search finds many kratom shops operating in the state. While this kratom is available, there are no restrictions on it. Therefore the kratom being sold in Wyoming does not necessarily have to be lab tested or properly labelled.

However, Wyomingites are free to buy and possess kratom without having to worry about being criminalized, as kratom is not listed as a controlled substance in Wyoming.

Wyoming marijuana laws are harsh. Possession of over three ounces constitutes a felony and may be punishable for up to five years in prison. Up to three ounces could render a year in prison and a $1,000 fine.

Wyoming has made no progress in passing modern cannabis or kratom laws. An attempt to decriminalize possession of marijuana in the city of Cheyenne failed in 2023.

Wyoming has a more progressive history than its recent stance on cannabis. Wyoming was the first state in the United States to grant women the right to vote in 1869. It was also the state where the first National Park in the world was established in 1872: Yellowstone National Park.
